By accessing or using the Dial2AI voice-based artificial intelligence service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you and Dial2AI ("Company", "we", "us", or "our").

2. Service Description

Dial2AI provides an artificial intelligence conversational service accessible through telephone calls. The Service allows users to engage in voice-based conversations with AI systems for educational, informational, and general assistance purposes.

Geographic Availability: The Service is currently available only to users located in the United States and Canada.

3. AI Limitations and Important Disclaimers

3.1 No Professional Advice

The Service is not a substitute for professional advice. Dial2AI does NOT provide any form of medical, legal, financial, or emergency assistance. You must not rely on the Service for advice on such matters.

3.2 AI Accuracy Limitations

You acknowledge that the AI system may provide incorrect, incomplete, or outdated information. AI responses are generated based on training data and may not reflect current events or the most recent information. You should independently verify any important information provided by the AI.

3.3 Emergency Situations

DO NOT USE THIS SERVICE FOR EMERGENCIES. In case of a medical, mental health, or any other emergency, please call 911 or your local emergency services immediately.

4. User Responsibilities and Acceptable Use

You agree to use the Service responsibly and in accordance with all applicable laws. You agree NOT to:

  • Use the Service for any illegal activities or to promote harm.
  • Harass, abuse, or threaten others through the Service.
  • Attempt to extract, reverse-engineer, or otherwise compromise our AI models or infrastructure.
  • Share explicit, harmful, or inappropriate content.
  • Impersonate others or provide false information during registration.
  • Attempt to overwhelm, disrupt, or gain unauthorized access to the Service.

5. Privacy and Call Recording

Call Recording Notice: By using this Service, you consent to the recording of your telephone conversations. These recordings may be used for quality improvement, AI training, customer support, and to ensure compliance with our terms. 6. Telecommunications

Our Service operates in compliance with FCC (Federal Communications Commission) regulations in the United States and CRTC (Canadian Radio-television and Telecommunications Commission) regulations in Canada. Service availability and call quality may vary based on your geographic location and telephone carrier. Standard telephone charges from your carrier may apply.

7. Billing and Payment

Pricing for the Service will be clearly communicated before you incur any charges. You agree to pay all applicable fees associated with your use of the Service. All fees are non-refundable unless required by law. We reserve the right to change our pricing with 30 days' notice. Failure to pay may result in the suspension of your account.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. DIAL2AI DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless Dial2AI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any applicable laws.

10. Service Modifications and Termination

We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We may also terminate or suspend your access for any violation of these Terms. You may terminate your account at any time by contacting customer support.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the provincial and federal courts located in Ontario, Canada.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
